One of the frequently asked questions among students is - if a student studying at a non-state higher education institution wants to transfer to another (especially state) university, is it possible to prevent this? At the same time, there are cases when some non-state universities gave students warnings that "if you fail the transfer exam, we will not admit you again." Is this situation legal? Let's analyze on a legal basis.

How is the transfer procedure regulated?

Transfer of students to another higher educational institution is carried out on the basis of the "Regulations on the procedure for transfer, reinstatement and expulsion of students," approved by the Cabinet of Ministers of the Republic of Uzbekistan.

According to paragraph 30 of the Regulation, the expulsion of a student on the basis of transfer to another university is carried out with the written consent of the student.

This means that if you cannot pass the transfer test to another university, if your studies at the previous university have not been terminated through a written application, you are still a student at that university.

Is it legal for a private university to say "we won't send you back"?

No, this is not legal. It is contrary to the existing legislation that a non-state university automatically expels a student for wanting to transfer to another university or for failing the test.

📌 Expulsion from studies is possible only with the student's written consent (i.e., application). Otherwise, the student has the right to continue his studies.

How to ensure student safety?

Don't write a written application before taking the transfer test.

First, successfully pass the test of the new university, then write an application and officially exit the old university.

If pressure is being exerted, you can contact the Ministry of Higher Education or the "legal portals" of the Ministry of Justice.
