According to the order of the Minister of Pre-School and School Education No. 565 of December 20, 2023, the duty of the teacher to check the attendance of students and enter it into the class journal is defined as part of the duties of the teacher. However, these obligations do not include the task of ensuring that students are in the classroom.

Therefore, it is wrong to apply a disciplinary measure to the head of the class for the low attendance of students. In this case, the disciplinary punishment is disproportionate to the actions of the teacher, and according to articles 301 and 313 of the Labor Code of the new version, the teacher can apply to the district justice department or the State Labor Inspectorate.

If students do not come to class, action can be taken against parents. According to Article 47 of the Code of Administrative Responsibility, if parents do not fulfill their obligations to raise and educate minor children, they may be fined from one to five times the amount of the base calculation.
