Articles 24/05/2025 The torment of the session: How are the rights of teachers or students who torment students protected?

Approximately a quarter of students in Uzbekistan face the problem of teachers who delay grades during sessions under various pretexts. This situation leads to moral and material damage for students. In this article, we will focus on the roots, consequences, and solutions to this problem.

Session...

The session is the most responsible and stressful period for students. At this time, it is important to receive grades in a timely manner, as this affects the student's future and motivation to study. Unfortunately, some teachers delay grading for various reasons, and sometimes expect "gratitude" from students. Such actions are a form of corruption and create a sense of injustice for students.Especially during the hot summer days, students experience the most difficult periods of the "golden age" when taking exams. Admittedly, the session will not present any difficulties for all students. However, when we inquired about students' opinions, one in four students received answers like "The teacher didn't give me grades and kept me running for a week," "He didn't give me grades," "It was difficult for me to get a grade because I argued in class," "He knocked me out with our group" during this year's session.

What is the root of the problem?

There are several reasons for this problem:

It must be admitted that in recent years, corruption during sessions in universities has been practically eliminated. If we do not occasionally hear about the corruption that students encounter 6-7 years ago, such unpleasant cases are very rare. However, one cannot turn a blind eye to the injustice associated with the irresponsibility of teachers. Some teachers are indifferent to their duties, delay the assessment process, and do not value students' time.

This may be due to weak control in the system. The insufficient system of control over the activities of teachers in higher educational institutions also contributes to the exacerbation of this problem. Shortcomings of the HEMIS system: It would not be an exaggeration to say that some shortcomings of the HEMIS system are part of the problem, which complicates the timely submission and monitoring of assessments. Some teachers try to delay grades by exploiting technical malfunctions in this system. The student, who wished to remain anonymous, said: "The HEMIS system has some shortcomings - the teacher can change grades as they wish. This affects transparency. It would be good if a separate system was created under the supervision of professors and teachers by the Ministry of Higher Education, Science and Innovation. We didn't struggle during the session." The student isn't "bright." Of course, one side of the problem lies with the teachers, and the other - with the students. We don't want to conclude this matter solely based on student opinion! We also took into account the opinions of the professors and teachers. According to the analysis, most students do not fully attend classes, and some do not have sufficient knowledge in mastering. This situation creates a negative opinion among teachers about students. Another aspect is that late grades cause serious moral and material damage to students: · Stress and depression: Uncertainty causes stress and depression in students. · Loss of enthusiasm: The feeling of injustice extinguishes students' interest in learning. · Material damage: Students are forced to show "gratitude" to teachers to get grades.

What is the responsibility if the teacher doesn't give grades on time? Part three of Article 313 of the Labor Code of the Republic of Uzbekistan stipulates that when applying disciplinary sanctions, the severity of the offense committed, the circumstances of its commission, and the employee's previous work and behavior are taken into account. Accordingly, a teacher's failure to assign grades in a timely manner can be considered a violation of labor discipline. Disciplinary action is applied when the employee does not actually fulfill their labor duties. In accordance with Article 312 of the Labor Code, for violation of labor discipline, the employer has the right to apply the following disciplinary measures to the employee: • Reprimand; · A fine not exceeding thirty percent of the average monthly salary. Termination of the employment contract. First of all, an explanatory note should be received from the teacher. If the teacher refuses to write an explanatory note, a report on the situation must be drawn up. Proposals for solving the problem To solve this problem, it is necessary to take the following measures: • Transparent assessment system: Assessment criteria should be clear and transparent. Strengthening control: It is necessary to strengthen the system of monitoring the activities of teachers in higher educational institutions. Protection of students' rights: The Ministry should pay special attention to the protection of students' rights and the consideration of their complaints. It is necessary to increase the responsibility of teachers and create a mechanism for applying disciplinary measures against them. · Improving students' knowledge: Increasing students' knowledge level, ensuring their attendance. Conclusion To prevent injustice towards students during the session, all stakeholders must work together. By working on the basis of transparency, control, responsibility, and legality, it is possible to create a fair and healthy educational environment.
