We previously reported on the approval of a new edition of the Law "On Education."
The document replaces the outdated laws "On Education" and "On the National Program for Personnel Training," which have been in effect since 1997. "Norma" briefly outlined the main differences of the new law.
Firstly, the classification of forms of education has been expanded:
- with and without interruption from production (full-time, part-time, evening, remote);
- theoretical - on the basis of the educational organization, practical - dual education conducted together at the student's workplace;
- family education and self-education;
- training and education of adults;
- Inclusive education for children (persons) with physical, mental, sensory, or mental disabilities;
- External education - includes independent mastery of educational programs, based on the results of which students undergo final and state attestations in state educational institutions;
- training of personnel in the field of defense, security and law enforcement activities.
Secondly, the powers of the Cabinet of Ministers, the State Inspectorate for Supervision of the Quality of Education (Education Inspectorate), the Agency for the Development of Presidential, Creative and Specialized Schools, as well as sectoral ministries and local government bodies have been clarified in detail.
Thirdly, more attention is paid to the legal status of all participants in the educational process:
- educational organizations - their creation, reorganization and liquidation, requirements for the charter;
- pedagogical workers, students, their parents and other legal representatives - on rights, obligations and guarantees. Measures for the social protection of participants in the educational process have been defined.
Fourthly, issues related to the implementation of state educational standards and requirements, curricula and programs in the educational process, experimental and innovative activities in the field of education are regulated. The mechanism of admission, including targeted admission, is described.
Fifthly, the levers of state regulation and control are regulated:
a) the first include:
- licensing of the activities of non-state educational organizations - licenses are issued by the Education Inspectorate for an unlimited period, separately for each type of education;
- certification and state accreditation of educational organizations is carried out by the Education Inspectorate for a period of 5 years. In this case, non-state educational organizations are considered accredited for 5 years from the date of obtaining the license, and upon expiration of this period, they undergo this certification and accreditation. Organizations that have passed state accreditation are included in a special register, information about which is posted on the website of the Education Inspectorate;
- recognition of a document on education received in a foreign state after January 1, 1992, as well as apostille on official documents in the field of education. Recognition and apostille are also within the competence of the Education Inspectorate;
b) The Education Inspectorate has the right:
- implementation of control and monitoring of the quality of the educational process in non-state educational organizations - with notification of the Business Ombudsman;
- in cases of detection by educational organizations of non-compliance of the content and quality of education with the legislation on education - to submit to them proposals for their elimination. In case of non-compliance with the submission - annulment of the certificate of state accreditation of the educational organization.
