Employee vacation pay is calculated based on the average monthly salary. Therefore, from the period for calculating the average wage, certain periods and amounts accrued during this period are excluded.
In accordance with Article 257 of the Labor Code, the following cases are excluded from the average wage:
What income and time is not taken into account?
👉 Times when average salary was maintained, if work wasn't actually done during this time:
‒ For example: vacation, business trip, vacation at the initiative of the employer, etc.
- EXCEPTION: breaks for feeding the child (Article 407).
👉 Times when temporary disability benefits were received (i.e., days when medical referrals and sick leave certificates were issued).
👉 Times when maternity benefits were received (departure leave).
👉 Days of downtime outside of production, if this is due to circumstances beyond the control of the employer or employee.
👉 In accordance with Article 399, additional non-working days (paid non-working days provided for the care of disabled children and persons with disabilities since childhood).
👉 Other cases of dismissal,
‒ with full or partial retention of wages,
‒ or completely unpaid circumstances (for example, education, social leave, etc.).
For example, Azamat Akhmadov received a monthly salary of 5 million soums for 12 months. But for 2 months, he rested with a sick leave of 1 month (disability pension). In this case, when calculating the average salary, only 11 months of earnings are taken into account.
